You may have seen mention of this in the media, but what does it mean? In short it means big savings for the insurance industry and big losses for the innocent accident victim who will often be persuaded to settle their compensation claim for a lot less than it is worth.

Third party capture is the name given to a practice adopted by an increasing number of insurance companies where (usually following a road accident) they will contact the innocent victim very soon after the accident and try and persuade them to settle their compensation claim quickly. Some insurance companies have even taken to employing agents who will repeatedly telephone the victim and even make unsolicited visits to their home promising a sum of money providing the victim does not instruct a solicitor to pursue a claim.

Ask yourself why insurance companies are doing this. Is it (as they try and portray to the media) so they can offer a swift and hassle free service to victims of their policyholders negligence? Is it to prevent the victim being sucked into a long drawn-out court case? Or is it simply to settle the claim on the cheap and prevent the victim from obtaining independent legal advice?

We have had numerous examples of clients contacting us having already been offered a sum of money by the guilty driver’s insurer. Almost immediately we can establish that the offer is wholly inadequate since the insurance company has no incentive to investigate the full extent of any financial losses and without a medical report it is impossible to gauge how long it will be before you recover from your injuries. Remember, once you have settled your claim, that is it. You cannot go back to the insurance company to reopen your claim if you take longer to recover from your injuries or you find you cannot continue to work as hard as you did before the accident or you find you cannot manage to do DIY and gardening and have to pay someone to do it for you.
